variable scope issue with $provider in params.pp

It seems there is a scoping issue in params.pp, related to $provider

I changed the Unsupported provider error to try and output $provider, but it is an empty variable.

Running Puppet 3.4.2 here, could this be something to do with removal of support for http://docs.puppetlabs.com/guides/scope_and_puppet.html ?
